In an attempt to resolve the problem or the marriage between law and morality, Dr. John Ezenwankwor publishes this book, Law and Morality: An Appraisal of Hart's Concept of Law. In it, he delves into a critical analysis of the works of a British legal philosopher, Herbert Lionel Adolphus Hart (1907-1992), who made landmark contributions to the moral and legal questions surrounding human actions or conducts. Incidentally, he surpasses his master, Hart, in this book, (...) by correcting his mistaken and poor consideration of the influence of morality in holding the society together and his dismissal of legal enforcement of morality. Scholars are grateful to Cyril Lionel Robert James (1901-1989) and Herbert Aptheker (1915-2003) for their pioneering work in the field of slave revolts. What they've virtually never mentioned, however, let alone explored, was Aptheker’s practice of rendering James invisible. It is highly improbable that Aptheker did not know either of James or of his noteworthy study of the Haitian Revolution, given that the latter was related to the slave revolts that Aptheker did study. Aptheker’s neglect of James was (...) not an anomaly, but rather symptomatic of an ideology that rationalized extreme oppression. (shrink)

The article examines the issue of a necessary connection between the phenomena of law and morality. According to legal positiv- ism, morality is not a criterion of the legitimacy for legal norms. The law can have any content including absolutely immoral (the so-called “separability thesis”). Law issues are not connected with discussing the moral merits of a possible judicial decision. They are only closely related to studying various purely legal phenomena like precedents, judicial discretion, legislatures, etc. The ascriptive legal statements (...) theory proposed by the Oxford School of Law (Herbert Hart, Joseph Raz, and others) serves as the core of contemporary legal positivism. This theory is based on the notion of defeasibility for legal responsibility without any moral reasoning. There, phenomena of law are interpreted as purely linguistic, not social constructions. Analysis of pure law language should provide all the needful tools to extract hidden meaning from any legal norm. This analysis does not require going beyond the legal language since it does not describe any real situations in the world, but merely expresses legal requirements, allowing to legally qualify some observed events. It completely eliminates any references to moral principles from the analysis of legal language. However the critical reconstruction theory of ascriptive legal statements shows limitations of the legal positivism’s analytical approach to the phenomena of law. The example of a fictitious legal collision offered demonstrates limitations of the legal positivism approach to the understand- ing of law phenomena. This collision is a complex conceptual mix of Frankfurt-style examples and imaginary situations in the Trolley Problem widely known in analytical ethics. It clearly demonstrates the possible paradox of a law judgment in situations where conditions for the recognition and cancellation of legal liability are the property of two different (not necessarily openly contradictory) legal norms. It can serve as a strong argument in favor of contemporary theories of natural law (Lon Fuller, John Finnis, Ronald Dworkin, and others), which questioned the possibility of creating a theory of pure law. They considered it senseless and impossible to draw any strict border between moral and legal norms. Immoral law cannot have the particular property of creating a moral obliga- tion to follow such like a law. Law cannot be built on legality only, and the answers to all significant legal questions should be found in moral theories. (shrink)

Entretanto, de acordo com o raciocínio perpetrado na obra, é um fato empírico que os indivíduos muito raramente obedecem à lei meramente por deferência à sua autoridade. È sul soddisfacimento del requisito della giustizia che si fonda, come sostenne Agostino, l’eterogeneità tra uno Stato e un’accolita di furfanti? «Se non è rispettata la giustizia, che cosa sono gli Stati, se non delle grandi bande di ladri? Perché le bande di briganti che (...) cosa sono, se non dei piccoli Stati?». The article is concerned with the general characteristics of Aristotle’s theory of a genus-differentia definition. The authors examine the validity of the definitions in the framework of legal language and present some objections against the definitions of per genus proximum et differentia specificam as they are considered by Aristotle. At the same time, through the objections to the position of genus-differentia definition critics, it is proved that in a number of cases Aristotle’s theory is more preferable than the approach offered (...) by Herbert Hart, the proponent of analytical legal philosophy. The argument of Peter Hacker is used to reinstate Aristotle’s genus-differentia definitions. (shrink)

Fifty years ago this year a legal practitioner turned military intelligencer turned philosopher, Herbert Hart, published The Concept of Law, still deservedly best-seller in thought about law. It presents law, especially common law and constitutionally ordered systems such as ours, as a social reality which results from the sharing of ideas and making of decisions that, for good or evil, establish rules of law which are what they are, whether just or unjust. But right at its centre is (...) a chapter on justice, informed by Hart’s professional knowledge of Plato and Aristotle and the tradition of civilized thought about justice, thought which he sums up like this: “the general principle latent in [the] diverse applications of the idea of justice is that individuals are entitled in respect of each other to a certain relative position of equality or inequality.” “Hence”, he goes on, “[the] leading precept [of justice] is often formulated as ‘Treat like cases alike’; though we need to add … ‘and treat different cases differently’”. This article will say something about three aspects of this vast topic: (i) about the factual basis and normative grounds of equality; (ii) about the proposed principle of equal concern; and (iii) about laws and social policies that pursue equality by selective prohibition of direct and indirect discrimination, and of harassment or vilification, victimisation and offence. Two currently much discussed views about truth, truth pluralism and truth relativism, are found in Sellars’s writings. I show that his motivations for adoping these views are interestingly different from those shared by most of their recent advocates. First, I explain how Sellars comes to embrace a version of truth pluralism. I argue that his version overcomes a difficulty confronting pluralists, albeit at a serious cost. Then I argue that Sellars’s truth pluralism isn’t motivated by his interest in domains of (...) discourse beyond the “matter-of-factual.” Rather, the key to his truth pluralism, his analysis of truth as “semantical assertibility,” is motivated by the same consideration that leads him to adopt truth relativism. This is his interest in applying semantic notions to discourse that embodies conceptual structures other than ours. Despite their common motivation, I conclude that Sellars’s relativism is independent of, and indeed stands in tension with, the analysis of truth that underlies his pluralism. (shrink)

According to traditional logical expressivism, logical operators allow speakers to explicitly endorse claims that are already implicitly endorsed in their discursive practice — endorsed in virtue of that practice’s having instituted certain logical relations. Here, I propose a different version of logical expressivism, according to which the expressive role of logical operators is explained without invoking logical relations at all, but instead in terms of the expression of discursive-practical attitudes. Dewey’s book is the first systematic attempt at a pragmatistic logic (since the work of Peirce). Because of the ambiguity of the concept of pragmatism, the author rejects the concept in general. But, if one interprets pragmatism correctly, then this book is ‘through and through Pragmatistic’. What he understands as ‘correct’ will become clear in the following account. The book takes its subject matter far beyond the traditional works on logic. This classic collection of essays, first published in 1968, represents H.L.A. Hart's landmark contribution to the philosophy of criminal responsibility and punishment. Unavailable for ten years, this new edition reproduces the original text, adding a new critical introduction by John Gardner, a leading contemporary criminal law theorist.

Building on recent work, I present sequent systems for the non-classical logics LP, K3, and FDE with two main virtues. First, derivations closely resemble those in standard Gentzen-style systems. Second, the systems can be obtained by reformulating a classical system using nonstandard sequent structure and simply removing certain structural rules (relatives of exchange and contraction). I clarify two senses in which these logics count as “substructural.”.

Brandom's "inferentialism"—his theory that contentfulness consists in being governed by inferential norms—proves dubiously compatible with his own deflationary approach to intentional objectivity. This is because a deflationist argument, adapted from the case of truth to that of correct inference, undermines the criterion of adequacy Brandom employs in motivating inferentialism. Once that constraint is abandoned, moreover, the very constitutive-explanatory availability of Brandom's inferential norms becomes suspect. Yet Brandom intertwines inferentialism with a separate explanatory project, one that in explaining the pragmatic significance (...) of meaning-attributions does yield a convincing construal of the claim that the concept of meaning is normative. Locke's claims about the "inadequacy" of substance-ideas can only be understood once it is recognized that the "sort" represented by such an idea is not wholly determined by the idea's descriptive content. The key to his compromise between classificatory conventionalism and essentialism is his injunction to "perfect" the abstract ideas that serve as "nominal essences." This injunction promotes the pursuit of collections of perceptible qualities that approach ever closer to singling out things that possess some shared explanatory-level constitution. It is (...) in view of this norm regulating natural-historical inquiry that a substance-idea represents a sort for which some such constitution serves as the "real essence," i.e. as that on which all the sort's characteristic "properties" depend. In this field questions arise which are certainly difficult; but as I listened last time to members of the group, I felt that the main difficulty perhaps lay in determining precisely what questions we are trying to answer. I have the conviction that if we could only say clearly what the questions are, the answers to them might not appear so elusive. So I have begun with a simple list of questions about discretion which in one form or another were, (...) as it seemed to me, expressed by the group last time. I may indeed have omitted something and inserted something useless: if so, no doubt I shall be informed of this later. The central questions then seem to me to be the following: 1. What is discretion, or what is the exercise of discretion? 2. Under what conditions and why do we in fact accept or tolerate discretion in a legal system? 3. Must we accept discretion or tolerate discretion, and if so, why? 4. What values does the use of discretion menace, and what values does it maintain or promote? 5. This chapter first seeks to identify Huw Price's reasons for holding that "object naturalism" can be undermined by "subject-naturalistic" inquiry. It then addresses five questions about how his project bears on the prospects for a liberal naturalism. (1) Does Price’s strategy depend on his requirement that the relevant inquiry into human discourse and thought be conducted in natural-scientific terms? (2) Is Price’s strategy even compatible with that requirement? This paper examines the pressures leading two very different Early Modern philosophers, Descartes and Locke, to invoke two ways in which thought is directed at objects. According to both philosophers, I argue, the same idea can simultaneously count as “of” two different objects—in two different senses of the phrase ‘idea of’. One kind of intentional directedness is invoked in answering the question What is it to think that thus-and-so? The other kind is invoked in answering the question What accounts for (...) the success of our proper methods of inquiry? For Descartes as well as Locke, the two kinds of “ofness” come apart as a result of strong rationalist commitments. However, I will suggest that even if we reject such commitments, we go wrong if we assume that a single kind of intentional directedness suffices to address both questions. (shrink)

According to Roman Ingarden, transcendental idealism prevented Kant from "even undertaking an attempt" at elucidating freedom "in terms of the causal structure of the world." I show that this claim requires qualification. In a remarkable series of Critical-period Reflexionen (5611-4, 5616-9), Kant sketches a defense of the possibility of freedom that differs radically from his published ones by incorporating an indeterministic account of the phenomena. Anticipating Łukasiewicz, he argues that universal causal determination is consistent with an open future: if an (...) action is contingent, there is an infinite regress of determining causes, yet there is a prior time at which this infinite series of causes has not yet commenced. However, he concedes that on this account the unity of experience "cannot fully obtain in the case of free beings." The fact that Kant even contemplated the indeterministic theory may carry implications for interpreting the argument of the Second Analogy. (shrink)

The nature of existence, which science seeks to investigate, is dynamic as novel discoveries are constantly presented. To explain such a dynamic existence, science itself needs to be dynamic. Methodological differentiation is one way in which science expresses dynamism. Such differentiation led to the theological and the natural sciences, and conflicting views regarding the nature of existence: the theological worldview versus the natural worldview. This study is a comparison of the conflicting worldviews of the theological and cosmological theories of the (...) beginning of existence. The study compares them in an attempt to redress the conflict and encourage dialogue between the two methods for a better representation of existence. The study exposes the limits of the theological and the natural worldviews. It proposes a relationship of dialogue between them so that they transcend their individual limits and are able to grow. Dialogue involves the interchange of ideas to broaden perspectives, which leads to growth. A relationship of dialogue emphasises similarities in presuppositions, methodology and content, and exploits these to attain a greater degree of certitude. Theology and natural science can be viewed analogically as two sides of the same coin, two aspects to one reality, that can collaborate, albeit independently, to reveal a broader view of reality. They can converse through dialogue, exchange ideas and share views, even though they remain methodologically exclusive, independent worldviews. Finally, dialogue involves a transformation of reason in that it expects theologians and natural scientists to change the way they view reality. If we were to transform our reasoning into something more complete, our worldview should represent a more complete representation of existence. This means that the theologian and the scientist can, occasionally, go beyond their scope and method and push their knowledge towards progress through dialogue. This makes “transformed reason” the method of dialogue, which redresses the conflict between theology and natural science and encourages interchange between them. (shrink)

Limited aggregationists argue that when deciding between competing claims to aid we are sometimes required and sometimes forbidden from aggregating weaker claims to outweigh stronger claims. Joe Horton presents a ‘fatal dilemma’ for these views. Views that land on the First Horn of his dilemma suggest that a previously losing group strengthened by fewer and weaker claims can be more choice-worthy than the previously winning group strengthened by more and stronger claims. Views that land on the Second Horn suggest that (...) combining two losing groups together and two winning groups together can turn the losing groups into the winning groups and the winning groups into the losing groups. This paper demonstrates that the ‘fatal dilemma’ is neither fatal nor a dilemma. The First Horn is devastating but avoidable and the Second Horn is unavoidable but not devastating. Nevertheless, Horton’s argument does help to narrow down the acceptable range of views. (shrink)

The clean separation between manifold phenomena and a systematic order that prevails in them is a basic feature of the rational-scientific orientation system. The first authoritative formulation of this premise is found in Plato. His discussion of constitutive forms of world events has initiated a broad development in the history of philosophy, which is also effective today in the preference for reason-guided analyses of often confusing circumstances. The authors of this volume address the lasting relevance of this idea within two (...) interrelated areas of research, namely Plato scholarship and contemporary Platonism. Of particular interest is the relationship between Plato and Wittgenstein. Following this overall idea, this volume is divided into three sections: Plato scholarship, Platonism, and Plato and Wittgenstein. As the contributions show, Platonism proves to be not only a purely historical-exegetical field of research but rather a fruitful stimulus for contemporary discussions on logical, linguistic, and social topics. We present a technique for the analysis of pattern formation by a class of models for the formation of ocular dominance stripes in the striate cortex of some mammals. The method, which employs the adiabatic approximation to derive a set of ordinary differential equations for patterning modes, has been successfully applied to reaction-diffusion models for striped patterns [1]. Models of ocular dominance stripes have been studied [2,3] by computation, or by linearization of the model equations. These techniques do not provide (...) a rationale for the origin of the stripes. We show here that stripe formation is a non-linear property of the models. Our analysis indicates that stripe selection is closely linked to a property in the dynamics of the models which arises from a symmetry between ipsilateral and contralateral synapses to the visual cortex of a given hemisphere. Infertility, the inability to get pregnant after twelve months or more regular unprotected sexual intercourse is a global phenomenon but among the Ikwerre people of Rivers State, the blame of infertility in the family is always shifted to the woman despite the discovery of modern diagnosis that reveals that men and women can be responsible for childlessness. This research brings to bear the fact that modernity has not affected the Ikwerre people on the blame game of infertility in families. Thus, (...) this paper looked at the problem of infertility using a structured questionnaire of 4-point Likert scale, analyzed the data with a descriptive statistics and simple percentage for the socio-demographic distribution of respondent while mean and standard deviations were used to analyze the research questions. It adopted the use of Fertility Awareness Methods Theory as a panacea to the blame of infertility and concludes that knowledge of the reproductive anatomy and physiology of couples as it relates to fertility will help them make informed decisions concerning childbearing. Este ensayo examina la idea de tolerancia en nuestra sociedad industrial avanzada. La conclusión a la que se llegó es que la realización del objetivo de la tolerancia requeriría intolerancia hacia las políticas, actitudes y opiniones prevalecientes y la extensión de la tolerancia a políticas, actitudes y opiniones que están prohibidas o reprimidas. En otras palabras, hoy la tolerancia aparece nuevamente como lo que era en sus orígenes, a principios del período moderno: un objetivo partidista, una noción y una práctica (...) liberadora subversiva. Por el contrario, lo que hoy se proclama y practica como tolerancia, en muchas de sus manifestaciones más efectivas sirve a la causa de la opresión. (shrink)

Haken’s slaving principle is used to derive differential equations for unstable mode amplitudes close to the Turing instability. This connects a dynamical symmetry to pattern selection, with possible relevance to biological and chemical pattern-forming phenomena.

In this chapter, Ricardo Silvestre and Alan Herbert offer a reconstruction of the Gītā’s concept of God with a focus on the relationship between God and the world. They try to explain the claim that the Gītā is panentheistic. This is done with the help of some key notions of contemporary metaphysics (such as ontological dependence and fundamentality) along with the Indic notion of prakṛti, considered as a metaphysical primitive denoting the intimate relationship that exists between matter and conscious (...) living beings on the one hand, and God on the other. This book analyses the concepts of God in Vaisnavism, which is commonly referred to as one of the great Hindu monotheistic traditions. Addressing the question of what attributes God possesses according to particular textual sources and traditions in Vaisnavism, the book analyses Vaisnava traditions and texts in order to locate them within a global philosophical framework. The book is divided into two sections. The first one, God in Vaisnava Texts, deals with concepts of God found in the canonical Vaisnava texts: (...) the Bhavagad Gita, the Bhagavata Purana, the Pancaratras, and the Mahabharata. The second section, God in Vaisnava Traditions, addresses concepts of God found in several Vaisnava traditions and their respective key theologians. As well as the Alvars, five traditional Vaisnava schools- the Sri Vaisnava tradition, the Madhva tradition, the Nimbarka tradition, the Pustimarga tradition, and the Caitanya Vaisnava tradition- and two contemporary ones Ramakrishna's and Swami Bhaktivedanta's are considered. The book combines normative, critical and descriptive elements. Some chapters are philosophical in nature, others are more descriptive, unpacking a specific Vaiṣṇava concept of God for future philosophical analysis and critique. The program explodes an entity in the Ethics either (1) forward to the tree of all propositions that depend upon the entity or (2) backwards to the tree terminating at the axioms, definitions, lemmas or propositions on which the proof of the entity depend. The paper gives instructions to download and implement the program in Windows.

Historically, laws and policies to criminalize drug use or possession were rooted in explicit racism, and they continue to wreak havoc on certain racialized communities. We are a group of bioethicists, drug experts, legal scholars, criminal justice researchers, sociologists, psychologists, and other allied professionals who have come together in support of a policy proposal that is evidence-based and ethically recommended. We call for the immediate decriminalization of all so-called recreational drugs and, ultimately, for their timely and appropriate legal regulation. We (...) also call for criminal convictions for nonviolent offenses pertaining to the use or possession of small quantities of such drugs to be expunged, and for those currently serving time for these offenses to be released. The Axis II Work Group of the Task Force on Diagnostic and Statistical Manual of Mental Disorders (DSM-IV) has expressed concern that antisocial personality disorder (APD) criteria are too long and cumbersome and that they focus on antisocial behaviors rather than personality traits central to traditional conceptions of psychopathy and to international criteria. R. D. Hare et al describe an alternative to the approach taken in the DSM-III—Revised (DSM-III—R; American Psychiatric Association, 1987), namely, the revised Psychopathy Checklist. Spinoza’s geometrical approach to his masterwork, the Ethics, can be represented by a digraph, a mathematical object whose properties have been extensively studied. The paper describes a project that developed a series of computer programs to analyze the Ethics as a digraph. The paper presents a statistical analysis of the distribution of the elements of the Ethics. It applies a network statistic, betweenness, to analyze the relative importance to Spinoza’s argument of the individual propositions. The paper finds that a small (...) percentage of the propositions greatly exceed the majority in this importance. The paper then describes two logical structures that appear respectively in the Ethics and argues that they result in redundancy in the sense that about ten percent of the propositions could have been eliminated. The appendices list these structures and describes how the resources of the study can be made available to readers. (shrink)

Der akademischen Philosophie wird manchmal nachgesagt, sie suche Antworten auf Fragen, die außer Philosophen niemanden umtreiben. In diesem Band sind »zwölf philosophische Antworten« auf Fragen versammelt, die sich jeder irgendwann einmal stellt und über die professionelle Philosophen lediglich etwas schärfer und gründlicher nachdenken. Die Autoren dieses Bandes greifen pointiert, allgemeinverständlich und mit philosophischem Vertiefungsanspruch aktuelle Kontroversen auf. Less discussed than Hume’s skepticism about what grounds there could be for projecting empirical hypotheses is his concern with a skeptical regress that he thought threatened to extinguish any belief when we reflect that our reasoning is not perfect. The root of the problem is the fact that a reflection about our reasoning is itself a piece of reasoning. If each reflection is negative and undermining, does that not give us a diminution of our original belief to nothing? It requires (...) much attention to detail, we argue, to determine whether or not there is a skeptical problem in this neighborhood. Consider that if we subsequently doubt a doubt we had about our reasoning, that would suggest a restoration of some of the force of our original belief. We would then have instead of runaway skepticism an alternating sequence of pieces of skeptical reasoning that cancel each others’ effects on our justification in the original proposition, at least to some degree. We will argue that the outcome of the sequence of reflections Hume is imagining depends on information about a given case that is not known a priori. We conclude this from the fact that under three precise, explanatory, and viable contemporary reconstructions of what this kind of reasoning about reasoning could be like and how it has the potential to affect our original beliefs, a belief-extinguishing regress is not automatic or necessary. In our recent article, together with more than 60 of our colleagues, we outlined a proposal for drug policy reform consisting of four specific yet interrelated strategies: (1) de jure decriminalization of all psychoactive substances currently deemed illicit for personal use or possession (so-called “recreational” drugs), accompanied by harm reduction policies and initiatives akin to the Portugal model; (2) expunging criminal convictions for nonviolent offenses pertaining to the use or possession of small quantities of such drugs (and releasing those serving (...) time for these offenses), while delivering retroactive ameliorative relief; (3) the ultimate legalization and careful regulation of currently illicit drugs; and (4) the delivery of a new “Marshall Plan” focused on community-building initiatives, expanded harm reduction programs, and social and health care support efforts (Earp et al. 2021). We were gratified to see so many thoughtful commentaries on our proposal, and we respond to them in part in this reply. (shrink)

Lockheed Martin Corp. has funded research to generate a framework and methodology for developing semantic reasoning applications to support the discipline oflntelligence Analysis. This chapter outlines that framework, discusses how it may be used to advance the information sharing and integrated analytic needs of the Intelligence Community, and suggests a system I software architecture for such applications.

El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

Fourteen philosophers share their experience teaching Peirce to undergraduates in a variety of settings and a variety of courses. The latter include introductory philosophy courses as well as upper-level courses in American philosophy, philosophy of religion, logic, philosophy of science, medieval philosophy, semiotics, metaphysics, etc., and even an upper-level course devoted entirely to Peirce. The project originates in a session devoted to teaching Peirce held at the 2007 annual meeting of the Society for the Advancement of American Philosophy. Transoral laser microsurgery applies to the piecemeal removal of malignant tumours of the upper aerodigestive tract using the CO2 laser under the operating microscope. This method of surgery is being increasingly popularised as a single modality treatment of choice in early laryngeal cancers (T1 and T2) and occasionally in the more advanced forms of the disease (T3 and T4), predomi- nantly within the supraglottis. Thomas Kuhn, the American physicist turned philosopher and historian of science, coined the phrase ‘paradigm shift’ in (...) his groundbreaking book The Structure of Scientific Revolutions. He argued that the arrival of the new and often incompatible idea forms the core of a new paradigm, the birth of an entirely new way of thinking. This article discusses whether Steiner and col- leagues truly brought about a paradigm shift in oncological surgery. By rejecting the principle of en block resection and by replacing it with the belief that not only is it oncologically safe to cut through the substance of the tumour but in doing so one can actually achieve better results, Steiner was able to truly revolutionise the man- agement of laryngeal cancer. Even though within this article the repercussions of his insight are limited to the upper aerodigestive tract oncological surgery, his willingness to question other peoples’ dogma makes his contribution truly a genuine paradigm shift.
